This CCTV Surveillance Statement has been created by Lyttelton Port Company (LPC) to protect the safety and privacy of individuals, ensure compliance with its legal obligations under the Privacy Act 2020 and maintain the security of LPC sites, including City Depot and Midland Port (the LPC Sites). This CCTV Surveillance Statement should be read in conjunction with the [LPC Privacy Statement].
LPC wishes to provide a safe and secure environment to protect its staff, customers, suppliers, LPC Site visitors and the interests of the public by using Closed Circuit Television (CCTV) security cameras to:
Placement of CCTV equipment
CCTV equipment is placed in operational areas, LPC Site access points and car parks. This may capture some public areas which are adjacent to the perimeter of LPC Sites.
CCTV equipment will be placed in accordance with this CCTV Surveillance Statement and the location of CCTV equipment is at LPC’s absolute discretion.
Authorised LPC staff and contractors will select and position the CCTV equipment to be installed. Servicing of the equipment and checking recording quality will be attended to on a regular basis and as required.
Signage advising that CCTV equipment is installed is present in relevant areas to give individuals clear notice that the area is covered by CCTV.
The placement of CCTV equipment will not unreasonably intrude on the privacy of individuals.
Any interference or tampering with CCTV equipment (including removing, covering or damaging any CCTV equipment) may result in an individual’s removal from LPC Sites.
Collection, storage and use of CCTV footage
LPC will collect CCTV footage in accordance with approved LPC security plans with the aim of maintaining the security of LPC Sites and the safety of individuals.
The CCTV equipment is a mix of constantly recording and movement-activated cameras. Recording and capture runs 24×7, 365 days per year. CCTV footage collected by LPC will not contain any audio recordings.
CCTV footage is stored in a secure location, subject to specific access controls, and will be stored for up to 60 days before being overwritten in a continuous recording cycle.
Where an incident, a near-miss or an example of good practice has taken place at a LPC Site and is recorded by CCTV, LPC may choose to retain this footage for longer than the standard 60 days. LPC may use the footage in training and risk management reviews, in order to prevent similar incidents and/or promote positive examples in future. Once this footage is no longer relevant for training purposes, it will be deleted.
Access to CCTV footage will be available to authorised LPC staff and will be viewed on each occasion only in accordance with the purposes set out in this CCTV Surveillance Statement.
Any criminal activity detected by CCTV will be alerted to New Zealand Police (and/or other relevant agencies, such as New Zealand Customs Service) for investigation.
Sharing of CCTV footage
In specific circumstances, the LPC Privacy Officer may allow limited access to CCTV footage by third parties, including (but not limited to):
Where access is granted to any CCTV footage, such access will be limited only to the footage necessary to achieve the purpose for which it was shared. Where appropriate, LPC will implement restrictions on third parties that receive any CCTV footage via robust data sharing agreements.
CCTV access and complaints
Where an individual wishes to view footage related to themselves, they can make a request via office@lpc.co.nz, addressing the email for the attention of the LPC Privacy Officer. Any such request will be assessed in accordance with the accessibility to the footage and the need to protect the privacy of other individuals.
