Privacy Statement

Lyttelton Port Company Limited (LPC) is committed to ensuring that your privacy is protected. This Privacy Statement governs the collection, use and disclosure of your personal data by us and has been prepared in accordance with our obligations and your rights set out in the New Zealand Privacy Act 2020. We reserve the right to modify or amend this Privacy Statement at any time and for any reason.

Purpose

LPC collects, stores, uses and discloses personal information about individuals that visit all Lyttelton Port sites, including Midland Port and CityDepot (the LPC Sites) and from the LPC website when an individual contacts us.

LPC collects, stores, uses and discloses this personal information:

  • to ensure the smooth running of LPC operations;
  • for health and safety purposes;
  • for security purposes;
  • to comply with the requirements of legislation, official agencies and (where relevant) contractual obligations;
  • to manage administrative processes; and
  • to respond to any queries submitted to LPC via the LPC website.

Upon visiting an LPC Site or submitting a question via the LPC website, you authorise the collection, storage, use and disclosure of your personal information as set out in this Privacy Statement on the understanding that LPC will observe its legislative obligations, including abiding by the Information Privacy Principles set out in the Privacy Act 2020.

Collection of Personal Information

LPC will collect personal information:

  • directly from the individual as part of their induction process at LPC Sites and during their ongoing engagement with LPC;
  • directly from an individual who submits a query via the LPC website; and/or
  • via video surveillance when an individual travels through a video surveillance area at or near a LPC Site.

LPC will only collect personal information that is necessary for security purposes, for health & safety purposes, as required by relevant legislation.

Video surveillance data is collected in accordance with LPC’s CCTV Surveillance Statement. Signage will be present in any areas where video surveillance data is collected.

Types of Personal Information

When an individual visits an LPC Site, LPC collects their name, telephone number and email address.

This information is necessary to allow an individual to securely and safely access LPC Sites.

Personal information will be verified by an LPC staff member against photo identification provided by the individual upon their arrival at an LPC Site. LPC will not store a copy of the photo identification.

When an individual submits a query via the LPC website, they will be asked for their name and email address. LPC may request further personal information if necessary to deal with the query.

Sharing Personal Information

In the event of a security, biosecurity, customs or health & safety incident at a LPC Site, LPC may be required to provide an individual’s personal information to government agencies, regulatory bodies or other third parties, such as (without limitation):

  • New Zealand Police;
  • NZ Transport Agency Waka Kotahi;
  • Maritime NZ;
  • Worksafe;
  • New Zealand Customs Service;
  • Environment Canterbury; or
  • the individual’s employer (where relevant).

LPC will only share personal information in accordance with this Privacy Statement and the Privacy Act 2020.

Storage and Security of Personal Information

LPC will maintain appropriate storage and security for all personal information which it collects in accordance with accepted industry practices.

LPC will only retain and store personal information for as long as is required for the purpose for which the information was collected, or as required by applicable law.

Access to and correction of Personal Information

Individuals have the right to:

  • access information held by LPC about them; and
  • correct any inaccurate information LPC holds about them.

Individuals can only ask for information about themselves and they cannot request information about another person, unless they are acting on that person’s behalf and have written permission.

An individual who wishes to have access or make a correction to any personal information held by LPC, or complain about the use, storage or disclosure of their personal information held by LPC, may do so by contacting office@lpc.co.nz, addressing the email for the attention of the LPC Privacy Officer.

Privacy breaches

LPC takes the protection of personal information very seriously and needs to be aware of any privacy breaches (including any suspected breaches).

A breach may include any loss, unauthorised sharing or accidental publication of personal information.

If an individual becomes aware of a privacy breach (or a suspected breach) or has concerns about the use, sharing or storage of their own personal information, they may contact office@lpc.co.nz, addressing the email for the attention of the LPC Privacy Officer.
